Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer and sell our products.
These Terms of Service (“Terms”) apply to your use of our website and to purchases made through our online store. Please read them carefully before placing an order.
Nothing in these Terms affects any rights you have under applicable consumer law.
2. Using Our Website
You may use our website only for lawful purposes.
You must not misuse the website, attempt to gain unauthorised access to it, introduce malicious software, interfere with its operation, use it fraudulently, or use it in a way that infringes the rights of another person.
You are responsible for ensuring that information you provide to us, including your name, billing information, delivery address and contact information, is accurate and complete.
If you create an account, you are responsible for maintaining the confidentiality and security of your account credentials.
3. Our Products
We specialise in natural crystals, minerals, fossils, selenite and related products.
Because many of our products are natural materials, variations in colour, pattern, texture, shape, inclusions, transparency, surface characteristics and other natural features are normal and form part of the character of the product.
We make reasonable efforts to describe and photograph products accurately. However, colours and appearance may vary slightly depending on lighting, photography and the screen or device used to view the website.
Where a listing is for the exact specimen shown, the customer will receive that specimen unless the listing states otherwise. Where a product is sold from a group, batch or stock of naturally varying items, the item supplied may vary naturally from the example photographs.
Product dimensions and weights may be approximate unless expressly stated otherwise.
Nothing in this section limits your statutory rights where goods are faulty, not as described, of unsatisfactory quality or otherwise fail to meet requirements imposed by law.
4. Product Availability
All products are subject to availability.
We may withdraw or discontinue products and may limit quantities where reasonably necessary.
Placing a product in your basket does not reserve that product.
If, after you place an order, an item is unexpectedly unavailable, we will contact you and provide an appropriate refund for any unavailable item that has already been paid for.
5. Orders and Formation of Contract
When you submit an order through our website, you are making an offer to purchase the products in your order.
After receiving your order, we will normally send an electronic acknowledgement or confirmation.
A binding contract between you and us is formed when we accept your order.
We may decline or cancel an order where there is a legitimate reason to do so, including suspected fraud, an obvious pricing or listing error, inability to obtain payment, product unavailability, shipping restrictions, or where fulfilling the order would be unlawful.
If we cancel an order after payment has been taken, we will refund the appropriate amount using the original payment method.
Nothing in this section limits any statutory cancellation or refund rights available to consumers.
6. Prices and Payment
Prices displayed on our website are shown in the currency applicable to the customer's selected market or location where supported by our store.
Prices and promotions may change from time to time. Changes will not normally affect an order that we have already accepted, except where permitted or required by law.
Applicable delivery charges are shown during checkout before the customer places the order.
Where applicable, prices include UK VAT.
For international orders, customs duties, import taxes, handling charges or other charges may apply depending on the destination and applicable law. Where such amounts are not collected by us at checkout or included in the shipping service, the recipient may be responsible for them.
Payment must be made using one of the payment methods offered at checkout.
7. Shipping and Delivery
Available shipping services, delivery charges and estimated delivery times are displayed at checkout and depend on the products ordered, total shipment weight and delivery destination.
UK orders may be shipped using different parcel formats depending on the size and weight of the products ordered.
International delivery is available only to destinations and products for which a shipping option is displayed at checkout. We may restrict certain heavy, bulky or otherwise unsuitable products to UK delivery only.
International shipping services offered by us are tracked unless expressly stated otherwise at checkout.
Delivery estimates are estimates rather than guaranteed delivery dates unless we expressly agree otherwise.
We are not responsible for delays caused by circumstances outside our reasonable control, including carrier disruption, severe weather, customs procedures, border controls or other exceptional events. This does not affect any statutory rights you may have concerning delivery.
For consumer purchases, goods generally remain at our risk until they come into the physical possession of you or a person identified by you to receive them, except where the law provides otherwise.
Please ensure that the delivery address entered at checkout is complete and accurate. Contact us as soon as possible if you discover an error.
8. International Orders, Customs and Import Requirements
Customers ordering from outside the United Kingdom are responsible for ensuring that the products they order may lawfully be imported into their destination country.
Certain fossils, minerals, natural materials or other goods may be subject to destination-specific customs, import or regulatory requirements.
International customers may be required to pay customs duties, import VAT, taxes, brokerage or handling charges where these are not collected in advance or included in the shipping service.
Customs procedures can cause delays outside our reasonable control.
We reserve the right to decline an international order if we reasonably believe that the product cannot lawfully or safely be shipped to the destination.
9. Cancellations, Returns and Refunds
Consumer cancellation, return and refund rights are explained in our Returns & Refunds Policy, which forms part of these Terms.
Nothing in these Terms or our Returns & Refunds Policy excludes or restricts rights that cannot legally be excluded or restricted.
For eligible distance purchases, UK consumers generally have statutory cancellation rights. Applicable time limits, return procedures, refund arrangements, exceptions and responsibility for return postage are explained in our Returns & Refunds Policy.
Faulty, damaged, incorrect or misdescribed goods are dealt with in accordance with applicable consumer law and our Returns & Refunds Policy.
10. Natural Products
Crystals, minerals, Selenite, fossils and other natural materials can contain naturally occurring variations, fractures, fissures, inclusions, cavities, uneven surfaces, colour differences and other characteristics.
Such characteristics are not necessarily defects.
However, this does not affect your statutory rights if a product is damaged beyond what was described or reasonably expected, is not as described, is of unsatisfactory quality, or is otherwise faulty.
Natural products should be handled appropriately. Some minerals and fossils may be fragile, sharp, heavy or unsuitable for children.
Unless expressly marketed for such a purpose, our products are sold as decorative, collectible or display items and should not be treated as toys.
11. Product Information and Non-Medical Use
Any information provided about traditional, spiritual, metaphysical, historical or cultural associations with crystals or minerals is provided for general interest only.
Our products and website content are not intended to diagnose, treat, cure or prevent any medical or psychological condition and are not a substitute for professional medical advice, diagnosis or treatment.
12. Intellectual Property
Unless otherwise stated, the content of this website, including our original text, photographs, graphics, logos, videos, branding and website materials, is owned by or licensed to MIMONA SELENITES & FOSSILS LTD and is protected by applicable intellectual-property law.
You may access and use the website for personal, non-commercial purposes.
You must not reproduce, republish, distribute, sell, commercially exploit or materially modify our protected content without our prior written permission, except where permitted by law.
Third-party trademarks, names and content remain the property of their respective owners.
13. Reviews and Customer Content
If you submit a product review, photograph, feedback or other content to us, you confirm that the content is genuine, that you have the right to submit it, and that it does not infringe another person's rights or contain unlawful material.
Where legally permitted, you grant us a non-exclusive, worldwide, royalty-free licence to display and use content that you voluntarily submit in connection with operating and promoting our business and products.
We may moderate or remove content where reasonably necessary, including content that is unlawful, fraudulent, abusive, irrelevant, infringes third-party rights or breaches these Terms.
We do not permit fake or misleading reviews. Where a review has been incentivised, this should be disclosed as required by applicable law.
14. Third-Party Services and Links
Our website may use or link to third-party services, including payment processors, delivery providers, review services, social-media platforms and other technology providers.
Third-party websites and services may be governed by their own terms and privacy policies.
We are not responsible for the content or operation of independent third-party websites that are outside our control.
15. Shopify
Our online store is hosted using Shopify.
Shopify provides technology and ecommerce infrastructure used to operate the store, but purchases made from our store are contracts between the customer and MIMONA SELENITES & FOSSILS LTD, not between the customer and Shopify.
Shopify may process personal information in connection with providing its services. Further information about personal-data processing is provided in our Privacy Policy and, where applicable, Shopify's own privacy information.
16. Privacy
We process personal information in accordance with our Privacy Policy and applicable data-protection law.
Please refer to the Privacy Policy available through our website for information about the personal information we collect, why we use it, who it may be shared with, international transfers where applicable, and your data-protection rights.
17. Website Availability and Accuracy
We aim to keep the website available and the information on it accurate, but we cannot guarantee that the website will always be uninterrupted or error-free.
We may correct typographical errors, inaccuracies or omissions and update product descriptions, availability, pricing, shipping information or other website content.
If an error materially affects an order you have already placed, we will deal with the matter fairly and in accordance with applicable law.
18. Liability and Consumer Rights
Nothing in these Terms excludes or limits liability where it would be unlawful to do so.
In particular, nothing in these Terms excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any statutory consumer rights that cannot legally be excluded or restricted.
If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill, subject to applicable law.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
If you are purchasing wholly or mainly for business purposes, different legal rules may apply and you should contact us if you require specific business or wholesale terms.
19. Events Outside Our Reasonable Control
We will not be responsible for delay or failure to perform an obligation where that delay or failure results from circumstances outside our reasonable control.
If such circumstances materially affect an order, we will take reasonable steps to minimise the impact and communicate with you where appropriate.
Your statutory rights remain unaffected.
20. Suspension or Termination of Website Access
We may suspend or restrict access to our website where reasonably necessary, including for maintenance, security, suspected fraud, unlawful activity or material breach of these Terms.
Termination or suspension does not affect rights and obligations that arose before termination.
21. Severability
If any provision of these Terms is found by a court or competent authority to be unlawful or unenforceable, the remaining provisions will continue in effect.
Where appropriate, the affected provision will apply to the maximum extent permitted by law.
22. Waiver
If we delay in enforcing a right under these Terms, that does not necessarily mean that we have waived that right.
A waiver on one occasion does not automatically constitute a waiver on another occasion.
23. Changes to These Terms
We may update these Terms from time to time, including to reflect changes to our business, website, services or applicable law.
The current version will be published on this page with an updated revision date.
Changes will not retrospectively remove rights that have already arisen under an existing contract unless permitted by law.
24. Governing Law and Jurisdiction
These Terms and contracts made through our website are governed by the laws of England and Wales, subject to any mandatory consumer protections that apply to you.
If you are a consumer resident elsewhere in the United Kingdom, you may also have rights to bring proceedings in the courts applicable to the part of the United Kingdom in which you live.
If you are an international consumer, mandatory consumer protections and jurisdictional rights in your country of residence may also apply where required by law.
